TinyMCE can't handle ampersands, causing validation error Options

I'm having trouble with TinyMCE.

If I type an ampersand (&) in WYSIWYG view, then save and publish, then validate with the W3C XHTML validator (validator.w3.org) it spits an error complaining about the presence of '&'. It does not show up in the HTML source as '&' like it should, but just '&'.

I've found the only way to successfully pass validation and use ampersand is to, in WYSIWYG mode, type '&', then hit Save/Publish. When the node refreshes, the '&' has turned into '&'. If you validate this, then it passes. If you hit Save/Publish one more time, it fails validation.

TinyMCE sounds like the culprit to me. I don't have tidy enabled. Does anyone have any pointers as to the cause of this problem and can identify a possible solution?
